Terms of Service

1. Platform Operator

ezZzy Marketplace is operated by ezZzy Co., Ltd., registered in Thailand.

ezZzy acts as an intermediary platform connecting buyers and sellers. We are not a party to transactions between users unless explicitly stated. (Per Civil and Commercial Code, Sections 354-368)

2. Acceptance & Eligibility

By using ezZzy, you agree to these Terms of Service, our Privacy Policy, and all applicable Thai laws.

You must be at least 18 years old (the age of majority under Thai law) to create an account.

If you use ezZzy on behalf of a company or legal entity, you confirm you have authority to bind that entity to these terms.

Any terms found to be unconscionable or giving one party an excessive advantage may be deemed void under the Consumer Protection Act B.E. 2522, Section 35-bis.

3. Account Registration & Security

You are responsible for maintaining the confidentiality of your account credentials.

You are liable for all activities conducted under your account.

You must provide accurate and truthful registration information.

We may suspend or terminate accounts that violate these terms, provide false information, or engage in fraudulent activity.

4. Marketplace Rules

All listings must contain accurate, truthful descriptions and genuine photographs. False or misleading advertising is prohibited under the Consumer Protection Act B.E. 2522, Sections 22-27, and may result in criminal penalties (fine up to 500,000 THB and/or imprisonment up to 6 months).

Prohibited items include: counterfeit goods, illegal substances, weapons, items violating intellectual property rights, regulated products without proper licenses, and any items prohibited under Thai law.

All prices must be displayed in Thai Baht (฿) and must include VAT if the seller is VAT-registered. Hidden fees are prohibited under the Consumer Protection Act.

5. Buying & Selling

Buyers agree to pay for items they purchase or win at auction.

Sellers agree to ship items as described, within the committed timeframe, and provide tracking information.

ezZzy facilitates transactions but is not a party to them. Under the Product Liability Act B.E. 2551, manufacturers, importers, and sellers bear strict liability for defective products.

6. Auctions

Bids placed on ezZzy auctions are binding commitments to purchase.

The highest bidder at auction close wins the item, subject to any reserve price set by the seller.

Proxy bidding, auto-bid, and Make Offer features are subject to auction-specific rules displayed on each listing.

Bid sniping protection: auctions extend automatically if a bid is placed in the final minutes (anti-snipe).

7. Right of Withdrawal (Cooling-Off Period)

Under the Direct Sales and Direct Marketing Act B.E. 2545, Section 35, you have the right to cancel any purchase made through our platform within 7 days of receiving the goods, without giving any reason.

To exercise this right, notify the seller through the platform or contact support@ezzzy.shop.

The seller must issue a full refund within 15 days of receiving your cancellation notice.

The seller bears return shipping costs for cancellations within the cooling-off period.

This right cannot be waived by contract. Any clause attempting to limit this right is void under Thai law.

8. Payments

All payments are processed through approved payment providers. ezZzy does not store payment card details directly.

Accepted payment methods include Cash on Delivery (COD) and PromptPay. Additional methods may be added.

Payment processing is subject to Bank of Thailand regulations.

9. Fees & Commissions

Sellers may be subject to commission fees as outlined in the Seller Terms.

Fee schedules are displayed in the seller dashboard and updated with at least 30 days advance notice.

VAT-registered sellers must issue e-Tax invoices as required by the Revenue Code.

10. Disputes & Resolution

Disputes between buyers and sellers should first be resolved through our platform's dispute resolution system.

If unresolved, either party may file a complaint with the Consumer Protection Board (OCPB) at no cost.

Claims up to 300,000 THB may be filed at the Small Claims Court (no lawyer required, simplified procedure).

Under the Consumer Case Procedure Act B.E. 2551, the burden of proof rests on the business, not the consumer.

11. Intellectual Property

Content you upload to ezZzy remains your property. You grant ezZzy a non-exclusive, royalty-free license to display, distribute, and promote your content on the platform.

Do not upload content that infringes third-party intellectual property rights.

ezZzy will respond to valid intellectual property complaints and may remove infringing content under the Computer Crime Act B.E. 2550.

12. Limitation of Liability

ezZzy is provided "as is" and "as available." We do not guarantee uninterrupted or error-free service.

We are not liable for: losses from transactions between users, service interruptions, third-party actions, or force majeure events.

This limitation does not exclude liability for intentional or grossly negligent acts (per Civil and Commercial Code, Section 373).

Our total liability to you shall not exceed the amount you paid to ezZzy (not to sellers) in the preceding 12 months.

13. Account Termination

You may delete your account at any time through account settings or by contacting support.

We may suspend or terminate accounts for: violation of these terms, fraudulent activity, repeated complaints, legal requirements, or prolonged inactivity.

Upon termination, pending orders and obligations remain in effect.

14. Governing Law & Jurisdiction

These terms are governed by the laws of the Kingdom of Thailand.

Any disputes shall be subject to the jurisdiction of the Thai courts.

The Thai-language version of these terms prevails in case of any conflict with translations.

15. Changes to Terms

We may update these terms from time to time. Material changes will be notified via email and/or platform notification at least 30 days before taking effect.

Continued use of ezZzy after changes constitutes acceptance of the updated terms.
